ENGAGE FORT WAYNE PRIZE GIVEAWAY

OFFICIAL RULES

(Use of mobile device to enter may result in message and data rate charges to Entrant)

1. ELIGIBILITY. The Engage Fort Wayne Prize Giveaway (“Giveaway”) is open to legal residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years or older at the time of entry. Each person entering the Giveaway is an “Entrant”. Employees of the City of Fort Wayne, their spouses, immediate family members (children, parents, siblings, grandparents, grandchildren, and their respective spouses, regardless of their place of residency) and other members of the same household (whether or not related) are ineligible to participate. Only one (1) Giveaway entry per person is permitted. No groups, clubs or organizations may participate in the Giveaway. No Prize will be awarded to any individual not meeting the Giveaway eligibility requirements at the time of entry.

The Giveaway is subject to all applicable federal, state and local laws, rules and regulations and is governed by and construed under Indiana law. The Giveaway is void outside of the United States and where prohibited by law. By entering the Giveaway, Entrant agrees to comply with all appliable federal, state and local laws and the Official Rules, and to abide by all decisions of Engage Fort Wayne and the issuer of the Prize. Internet access is necessary in order to enter the Giveaway.

Engage Fort Wayne reserves the right to amend or add Entrant eligibility requirements and to impose additional terms and conditions on the Giveaway at any time in the discretion of Engage Fort Wayne.

2. SPONSOR. The Giveaway is sponsored by Engage Fort Wayne, a program created or operated by the City of Fort Wayne Community Development Division (“Engage Fort Wayne”).

3. HOW TO ENTER THE GIVEAWAY. Commencing on (March 9, 2026 at 4 p.m.) and ending on (March 19, 2026 at 5 p.m.) (the “Entry Period), each person who (i) creates an account on the EngageFortWayne.com website (“Entrant”) during the Entry Period and (ii) satisfies the Giveaway eligibility requirements will have the opportunity to win a Prize offered by Engage Fort Wayne. Any person who has created an account on EngageFortWayne.com prior to the commencement of the Entry Period will need to log in to their account and complete the Giveaway entry form. An Entrant must create an account on EngageFortWayne.com and complete the Giveaway entry form prior to the expiration of the Entry Period to be eligible for a Prize. No purchase is required to enter the Giveaway or receive a Prize. A purchase does not increase the chance of receiving a Prize. The odds of winning a Prize depend upon the number of eligible entrants participating in the Giveaway.

Entrants must include their first and last names and valid, verifiable email addresses to create an account on EngageFortWayne.com. The submission of additional entries using multiple email addresses, identities or devices is and may disqualify Entrant from participation in the Giveaway in Engage Fort Wayne’s sole discretion. Lost, late, misdirected, incomplete, illegible, damaged, undeliverable or delayed entries will be rejected by Engage Fort Wayne.

By creating an Engage Fort Wayne account, Entrant represents that: (i) he/she has read and agrees be bound by the Official Rules, (ii) he/she has satisfied the eligibility requirements to participate in the Giveaway, (iii) all information provided by Entrant is accurate in all respects at the time of entry and does not violate the rights of third parties or applicable law, and (iv) Entrant consents to being contacted by phone or email by Engage Fort Wayne in connection with any matter relating to the Giveaway.

Creation of an account does not establish proof of Entrant’s age, identity and eligibility which Entrant shall furnish to Engage Fort Wayne upon request. The Prize will not be awarded to any person not meeting all eligibility requirements at the time of entry.

The Entry Period begins on March 9, 2026 at 4 p.m. and ends on March 19, 2026 at 5 p.m. (“Entry Period”). All times in the Official Rules refer to Eastern Standard Time.

4. SELECTION AND NOTIFICATION OF WINNERS. On (March 20, 2026) three (3) potential winning Entrants will be randomly selected from all eligible Entrants who submit entries during the Entry Period. Engage Fort Wayne will notify each potential winning Entrant of his/her selection by email (“Award Notification”). Potential winning Entrants shall have seventy-two (72) hours from Engage Fort Wayne’s issuance of the Award Notification to respond by email which: (a) confirms Entrant’s acceptance of the Prize, (b) provides any additional information requested to verify Entrant’s eligibility to participate in the Giveaway and (c) includes the signed releases, consents and other Giveaway-related documents required by Engage Fort Wayne, all in a responding email to the Award Notification.

Engage Fort Wayne reserves the right to select an alternate winner from eligible Entrants if: (a) Engage Fort Wayne’s email to a potential winning Entrant is returned as undeliverable or (b) a potential winning Entrant : (i)declines to accept the Prize, (ii) does not satisfy the Giveaway eligibility requirements, (iii) fails to return all consents, releases and other required Giveaway-related documents, (iv) does not comply in all respects with the Official Rules, or(iv) does not respond to the Award Notification within the required seventy (72) hour time period.

Engage Fort Wayne shall have the sole and exclusive right to make all decisions with regard to all Giveaway-related matters and the Official Rules. Engage Fort Wayne reserves the right to disqualify Entrants who violate the Official Rules from participation in the Giveaway. All decisions made by Engage Fort Wayne shall be final and not subject to appeal.

5. PRIZE. The Prize awarded to a winning Entrant (the “Winning Entrant”) is four (4) tickets to the Fort Wayne Komets Hockey Game on March 28, 2026. A separate Prize will be awarded to each of the three (3) selected Winning Entrants who will be randomly selected by Engage Fort Wayne. The Prize is non-transferable, not redeemable for cash, and may not be substituted for another prize.

The Prize is valued at $177.80 (approximate retail value) which is the retail price at which the Prize is sold by the issuer of the Prize to the public at the commencement of the Giveaway and is subject to change. Each Winning Entrant shall be solely responsible for reporting the Prize on all applicable tax forms and returns and for the payment of any federal or state taxes or other costs and expenses associated with the award, acceptance and use of the Prize.

The Prize is expressly limited to the award of four (4) Komet Hockey Game Tickets. The Winning Entrant is responsible for the payment of all other expenses (including meals, gratuities, transportation, incidentals, souvenirs and fuel) associated with the acceptance and use of a Prize.

The Prize will not be replaced in the event of: (i) a cancellation or rescheduling of the Komet Hockey Game for which the Prize was awarded, (ii) weather conditions, (iii) the Winning Entrant’s inability or failure to accept or use the Prize for the purpose intended, (iv) the loss of the Prize by the Winning Entrant or (v) other conditions over which Engage Fort Wayne does not have control.

Engage Fort Wayne reserves the right to substitute the Prize or portion thereof for a prize of comparable or greater value should the Prize become unavailable for any reason. The Prize may be subject to certain terms or limitations imposed by the issuer of the Prize.

The Prize is awarded “As Is” to the Winning Entrant without any express or implied warranty of merchantability, fitness or other warranty, either express or implied, and may be subject to restriction or blackout dates.

The Prize must be claimed in person by the Winning Entrant between 8:00 a.m. and 5:00 p.m. on or before March 26, 2026 at the office of the Fort Wayne Community Development Division, Citizens Square, Suite 320, 200 East Berry Street, Fort Wayne, Indiana 46802. Winning Entrant must present a valid driver’s license or other valid government-issued photo identification acceptable to Engage Fort Wayne in its sole discretion. Failure to provide such identification when claiming the Prize may result in forfeiture of the Prize as determined by Engage Fort Wayne.

6. PUBLICITY. Except where prohibited by law, all Entrants grant Engage Fort Wayne permission to use their names, character, photographs, voices, videotapes and likenesses in connection with the marketing of Engage Fort Wayne and the promotion of the Giveaway and other contests without compensation, review or authorization. Entrants waive all claims to royalties, rights or remuneration from such use by Engage Fort Wayne.

7. LIMITATION OF ENGAGE FORT WAYNE LIABILITY

By entering the Giveaway, Entrant waives, releases and discharges and agrees to hold harmless and indemnify, to the extent permitted by law, the City of Fort Wayne and Engage Fort Wayne (and their respective officers, members, employees, representatives, agents, departments and divisions), jointly and severally, from and against (i) any tax liability that may be imposed upon the award, receipt and use of the Prize and (b) any actions, claims, damages, losses or injuries of any kind or nature, including property damage, personal injury or death ( collectively, “Claims “) arising in connection with the Giveaway and/or the award, receipt, ownership, use or misuse of the Prize, including without limitation Claims relating to: (i) lost, late, corrupted, stolen, misdirected, illegible or incorrect entries for the Giveaway, (ii) the malfunction of any computer, telephone, network, satellite, hardware, software, or communications line, (iii) unauthorized human intervention, (iv ) incorrect, delayed or inaccurate capture of information, (v) damage to any computer or mobile device, (vi) any errors in the Official Rules or Giveaway materials, Award Notifications or other announcements, or communications or processes relating to the Giveaway, (vii ) any error that may occur in the processing of entries or the administration of the Giveaway, and (viii) Entrant’s engaging in travel to and from, preparing for or participating in any Giveaway-related or Prize-related activity. Engage Fort Wayne is not responsible for any printing, typographical, mechanical or other error in the production or administration of the Giveaway or the announcement or award of the Prize. Engage Fort Wayne retains the discretion to make all decisions regarding the interpretation and application of the Official Rules, which decisions shall be final. The covenants of release and indemnification made by Entrant in this Section 7 shall survive the completion of the Giveaway and the award acceptance and use of the Prize.

In the event the Winning Entrant is ineligible to receive or refuses the Prize, the Prize will be forfeited and Engage Fort Wayne may randomly select an alternate Winning Entrant from the remaining Entries or may elect not to award the Prize to an alternate winner.

In the event of any ambiguity or error in the Official Rules, Engage Fort Wayne reserves the right to clarify or modify the Official Rules in its discretion to correct any such ambiguity or error.

Engage Fort Wayne reserves the right in its sole discretion to suspend, cancel or modify the Giveaway due to a force majeure event, computer virus infection, tampering, intervention, fraud, technical failures or other causes that affect the administration, security, fairness or conduct of the Giveaway. In the event of cancellation, Engage Fort Wayne reserves the right to award the Prize from among eligible Entrants. False or deceptive entries, acts or representations will render the Entrant ineligible. All entries become the property of Engage Fort Wayne and will not be returned.

8. ARBITRATION/CHOICE OF LAW

EXCEPT WHERE PROHIBITED, ENTRANTS AGREE THAT ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE GIVEAWAY SHALL BE RESOLVED EXCLUSIVELY BY ARBITRATION PURSUANT TO THE RULES OF THE AMERICAN ARBITRATION ASSOCIATION THEN EFFECTIVE, AND ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED BY ENTRANT WITH REGARD TO T HIS GIVEAWAY, BUT IN NO EVENT ATTORNEYS’ FEES, PUNITIVE, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR OTHER DAMAGES. All issues and questions concerning the construction, validity , interpretation and enforceability of these Official Rules, or the rights and obligations of entrants and sponsors in connection with the Giveaway shall be governed by and construed in accordance with the laws of the State of Indiana, without giving effect to any choice of law or conflict of law rules or provisions (whether of Indiana or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Indiana. Arbitration in Fort Wayne, Indiana shall be the exclusive forum and venue for any dispute relating to these official Rules and for this Giveaway. If arbitration is prohibited, then and in such event, the courts of Allen County, Indiana shall be the exclusive forum for any dispute relating to these Official Rules and/or the Giveaway. All Entrants, by their participation in the Giveaway, submit to the personal jurisdiction off the courts of Allen County, Indiana. The invalidity or unenforceability of any provision of these Official Rules shall not affect the invalidity or unenforceability of any other provision so long as the general intent of these Official Rules remains in effect. In the event that any such provision is determined to be invalid or otherwise unenforceable, these Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.

9. WINNING ENTRANTS’ LIST

For a list of Winning Entrants (available following end of Giveaway) and/or a copy of the Official Rules, send a hand-printed, self-addressed, stamped envelope to Engage Fort Wayne, Citizens Square, Suite 320, 200 East Berry Street, Fort Wayne, Indiana 46802 within ten (10) days following the completion of the Giveaway.

ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO INTENTIONALLY UNDERMINE THE PURPOSE AND/OR OPERATION OF THE GIVEAWAY OR TO DAMAGE THE ENGAGE FORT WAYNE WEBSITE IS A VIOLATION OF LAW FOR WHICH ENGAGE FORT WAYNE RESERVES THE RIGH TO SEEK DAMAGES AND PURSUE ALL OTHER REMEDIES AGAINST SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW.
